German father and son clients were on vacation touring the American Midwest in their rental car. As they were slowing down with traffic, a tractor trailer, driven by A.D. and owned by 1.O. Inc., collided into the back of their rental car at over 100 KPH (60 MPH). Both K.M. and A.M. temporarily lost consciousness and K.M. had to be removed from the rental car with the jaws of life. Although A.M. suffered whiplash and concussion injuries, he made a full recovery with rest and conservative treatment. However, K.M. suffered head trauma with a brain bleed (subarachnoid hemorrhage) and fractures of his midback (thoracic spine), requiring a 3 level fusion at T5-T8. Although K.M. made a good recovery under the circumstances, he suffers from restricted mobility, chronic pain, and sleep disturbances. After extensive litigation, the case was settled via court ordered mediation for $850,000 paid by 1.O. Inc.
